| WHAT IS A WILL AND WHO NEED ONE |
More than likely, a will is probably the most important legal document the average person will ever sign. It informs the state who has been selected to administer the deceased's property and other assets, to whom the assets are to be distributed and such vital family matters as who will be the guardian of minor children. An individual who dies without a will can saddle survivors with needless work, heavy administration expenses, (that a will may prevent) and estate tax liabilities that will eat up a good portion of the estate.
A person who dies with a valid will is said to have died testate, and a person who dies without a will is said to have died intestate. A Testator is the name given to the individual leaving a valid will. The Testator's estate consists of all assets, including money due, less debts and expenses. If an individual dies intestate, it is the state and not the individual or his family that determines how the estate will be distributed. The ONLY way an individual can make sure his wishes are carried out after death is to leave a will!
