"Regardless, sexual abuse
of the elderly is not uncommon,
said Moya Thompson
of the U.S. Administration on Aging.
According to a long-term care ombudsman report
to be released to Congress
before the end of the year,
there were 548 complaints of sexual abuse
in nursing homes nationwide
between Oct. 1, 1995, and Sept. 30, 1996 --
the most recent statistics available."

RESEARCH


Ann W. Burgess, Professor of Psychiatric Nursing,
is conducting preliminary research on
sexual abuse in nursing homes.

After having written
a paper on 18 cases from her own files,
she would like to develop a more
systematic study.

She would like to hear by
e-mail or fax from advocates,
families, and local and/or state ombudsmen
who are familiar with cases
involving sexual abuse.

She would then call them for a ten to fifteen
minute conversation to determine
some idea of the magnitude of the problem.

High time someone with money
and in a position to do,
so is looking into this formally.

I have very good documented cases.
The biggest known rape case in US nursing
home history involved the rape and
sodimization of 11 women for 2 1/2 yrs by a
white, male LPN in an Illinois nursing home.

The rapist was often left all alone
with more than 100 pts at night.

When one of the victims
got enough courage to tell her 85-yr old brother about
it, the brother talked
to the nursing home administrator.


He was told that if he could not
get his sister to shut up about being raped, he
could take her home.

The sister had to stay and was raped and sodomized
for another year.

Two women who were more able,
tried to kill themselves.
Some were taken to the hospital
repeatedly for vaginal and rectal bleeding.

Never once did the criminal
ER physicians and nurses report it. \
The hospital did business with the nursing home.
No one ever held them accountable for not
reporting the obvious rape injuries.

We proposed legislation in an attempt to stop this.
The nursing home owners
viciously attacked our legislation
that called for a female to be present
at the bedside of a female resident
who was receiving personal care by a male;
they wrote letters to all the legislators
stating that our legislation was racist
and a direct attack on the
black male.

It was a vicious attack that worked for them.
This is the reason I always publicize the race of the rapists.
Color has nothing to do with it.

A few months later, at the same home six cases of rape
were brought to light. The
rapist was a 58 yr. old white male kitchen worker.

The latest rape in MO was perpetrated
by a 62 year old white LPN.

Another rape case, a few months ago,
that received no publicity involved an
Alzheimer's man who was being repeatedly
raped by a homosexual resident.

Numerous reports were made to the administrator.
When someone finally called the
State, the inspector asked the administrator
why she allowed this to go on. The
admin. said:
"How was I to know it was not consensual?"
This is straight our of
a complaint investigation report in IL

In another case a young mentally ill man,
22 yrs old, schizophrenic since birth, was taught
how to use condoms by the administrator
and the nurses for safe sex.
(With whom, I wonder?)

After they missed 37 doses of his medication
in a period of a few months he
viciously raped and almost beat to death,
and left for dead, an elderly
Alzheimer's resident in the bathroom.

The sick young man is in prison, but the
owners the administrator and nurses are still
being paid to "care" for residents.

I worked with 60 minutes for months
on this expose with the
understanding that they would publish the owners' names.
When the story aired, the owners' names
were not mentioned.

These are but a few cases.
Rapes are covered up not
only by administrators and
owners but also
by state inspectors, by ombudsmen, the police and in some
cases by the press.

Get the surveys from your own state
licensing agencies and
read them, it is money and time well spent.

You will find plenty of documented
cases that nothing is ever done about.

We should all imagine our mother
as an 85 yr old frail woman in a nursing home
sick and unable to defend herself,
awakened in the middle of the night by an
animal and being viciously raped while
he is holding her mouth shut and
threatening to kill her if she tells.

Imagine the ultimate desspair and degradation,
the mortification, the pain., the fear, the injuries,
the wish for death that she cannot physically
bring about. Then wonder why some
would deny her the protection of a
surveillance camera.

Think also of the socio-economic profile of
those who are taking care of your
mother,

think of the 250% + turnover rate of the aides,
(don't believe for a
minute the 100% turnover rate
admitted to by the nursing home industry- our
experience shows this to be much too low )


think of the almost non existent
supervision, think of the understaffing,
think of the inadequate background
checks.
A rape is a rare, isolated incident? Not on your life!

As you may have guessed this is a topic very near to my heart.

When Carletos Bell applied to work at
the San Antonio Convalescent Center,
he didn't try to hide his violent criminal past.
He disclosed his record of aggravated assault
right on his application for nurse-assistant.

He got the job anyway, in June 1996.
Six months later, Bell was charged
with sexually assaulting a 71-year-old resident
of the nursing home.
He pleaded innocent and is now
in jail awaiting trial.
