WHAT IS THE OISC?

The Office of the Immigration Services Commissioner (OISC) is an independent public body set up under the Immigration and Asylum Act 1999.

The OISC is responsible for ensuring that all immigration advisers fulfill the requirements of good practice. They are committed to the elimination of unscrupulous advisers. The OISC is also responsible for:

Regulating immigration advisers in accordance with the Commissioner's Codes of Standards and Rules;

Maintaining and publishing the Register of Advisers;

Promoting good practice by immigration advisers;

Taking Criminal proceedings against unregistered advisers who now act illegally.

To register as an approved adviser it is necessary to sit the OISC examinations covering codes and standards, visas, citizenship and nationality, EU and EEA law, managed migration including the highly skilled migrants programme, sector based schemes, work permits etc. You must also prove your professional competence based on experience and an annual audit of your client’s files. You also have to pay a sizeable annual registration fee and have your accounts audited by an independent qualified accountant.


As there are many pitfalls and as immigration law can be very complex even a simple looking visa application form can be a challenge to many people. The OISC was established to protect the public from unscrupulous unqualified advisers and act as a source of advisers. You will see that many application forms now ask for your OISC advisers number and name. British Embassies also look favourably on a visas application made by an OISC adviser on behalf of a client.

As a prospective client you can be certain that you are dealing with a professional person who can really assist you with your case that may well be life changing.

It is now a criminal offence punishable by fines or imprisonment for anyone who is not registered with the OISC to give any form of advice or help on any matters concerning immigration (including visa applications) to anyone else, whether that assistance is given for profit or not, unless they are exempt from registration as practicing solicitors, barristers or legal executives, but the OISC deals with complaints against these persons as well as OISC registered advisers if a client receives negligent advice.

You will notice that immigration and nationality application forms such as SET(M) and the British Citizenship application now contain a space for the OISC adviser to enter their name and number and that they advise you to use a an OISC adviser which makes sense given the costs involved not only in monetary terms but also in worry and inconvenience if an application is rejected due to not having been completed correctly.
