Hi Everybody:

We finally had an up week on the Naz…A whopping 1.56 pts. But it is encouraging that a short base formed.

Although the Naz was slightly up for the week the total declining volume exceeded the advancing volume
5,167,000,000 to 5,108,000,000(rounded) and the average daily declining issues outpaced advancing 1579 to 1499. I still have the feeling that we may test the 1970’s which was the October highs as well as the 200 dma
if the 2025 level does not hold.

The major indices were all up for the week although the Q’s were down a tad. The DJ Composite saw 45 issues up and 20 down for the week…although on Friday it was 27 up 38 down.

Along with the Iraqi election today, there are quite a few economic announcements…including the FOMC and earnings reports due out. Should make for an interesting week…one way or the other. A few that will announce this week are XOM CME GOOG PEP PENN SNDA and of course, my favorite stock…WITS. (see EPS calendar link below)

***Gillette Co. (G) may be required to pay Procter & Gamble Co. (PG) a termination fee of .92 billion if the tie-up of the consumer-product titans falls apart under some circumstances, according to the merger agreement.

Gillette Chairman and Chief Executive James M. Kilts, who is slated to be vice chairman and a director at the combined company, also agreed to amend his employment agreement.

Under the amended agreement, Kilts will get options to buy 1 million shares of Procter & Gamble stock and 150,000 restricted shares. He agrees to stay on for one year and won't exercise stock options or sell stock for two years following the merger.

The closing of the merger would have otherwise entitled Kilts to terminate his employment, according to the Securities and Exchange Commission filing.
