AN ORDINANCE ESTABLISHING THE SALARY FOR THE MAYOR OF THE CITY OF NORTH RIDGEVILLE.

WHEREAS, the Council of the City of North Ridgeville deems it necessary to establish the Mayor’s salary; and

WHEREAS, the Council of the City of North Ridgeville desires to repeal Ordinances No. 3476-96, No. 3191-96 and No. 2814-2001;

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH RIDGEVILLE, LORAIN COUNTY, OHIO:

SECTION 1. That Ordinances No. 3476-96, No. 3191-96 and No. 2814-2001 be and the same are hereby repealed and shall no longer be in full force and effect.

SECTION 2. That effective January 1, 2001, the salary for the Mayor is hereby set at $71,282.79 per calendar year.

SECTION 3. That effective December 1, 2003, the salary for the Mayor is hereby set at $$63,426.45 per calendar year.

SECTION 4. That from and after the effect date of this Ordinance, effective January 1, 2004 the annual wages as set forth in this Ordinance shall annually include a cost of living adjustment in accordance with the U. S. Department of Labor Statistics Consumer Price Index

SECTION 5. Any ordinances or parts thereof in conflict with the provisions of this ordinance are hereby expressly repealed.

SECTION 6. It is found and determined that all formal actions of this Council concerning and relating to the adoption of this Ordinance were conducted in an open meeting of this Council, and that all deliberations of this Council and any of its committees that resulted in such formal action were in meetings open to the public in accordance with legal requirements, including Section 121.22 of the Ohio Revised Code.

SECTION 6. This Ordinance shall take effect and be in full force from and after the earliest period allowed by law.

2) BUILDINGS & LANDS COMMITTEE REPORT #7108 recommend approving T 141-2001, repealing credits to developers who provide excess surface water drainage detention or retention. APPROVED 7-0

3) UTILITIES COMMITTEE REPORT #7109 recommend approving the Gloria Street petition and resolution authorizing Engineer to prepare plans, specifications, cost estimates reflecting requested improvements APPROVED 7-0

4) UTILITIES COMMITTEE REPORT #7110 recommend approving T 139-2001, vacate storm water easement of Xavier Court APPROVED 7-0

5) UTILITIES COMMITTEE REPORT #7111 recommend approving an amendment to 1044.02 (d), (e) and (f) to include a minimum of 1 use benefit charge for each application ORDINANCE WAS APPROVED WITH BYLAWS SUSPENDED



Planning Commission Report of regular meeting held December 11, 2001

REQUEST: Final plan for cluster development which is part of Avalon Estates

PC ACTION: Application was accepted for final plat and plan of Phase 1 clusters, Villas of Avalon in Avalon Estates. The previous approval of Avalon Estates was amended to allow for the elimination of the three lots on Case Road until a later date when they may become part of the sewer assessment process. GILLOCK "SAID" THE RATIO OF CLUSTERS TO STANDARD RESIDENTIAL HOMES WAS CHECKED AND WAS WITHIN GUIDELINES FOR r-1. MINNICK ABSTAINED, APPROVED BY SIX MEMBERS

REQUEST: Sanitary Sewer extension along Race Road then west through this parcel to pick up existing manufacturing facilities in I-2 and I-3.

PC ACTION: The application was approved for the sanitary sewer extension as long as it meets the Master Plan requirements for serving the required area and is of a gravity flow nature. APPROVED 7-0

OTHER BUSINESS: Waterbury PCD, a cluster phase, information briefing by Rob Izer of Pulte Homes for Planning Commission input.
PC ACTION: An information briefing was held as scheduled. Please see the Planning Commission minutes of December 11, 2001 for details.


OTHER BUSINESS: T 138-2001 submitted by City Council for Planning consideration regarding clarification as to the placement of subdivision signs.
PC ACTION: Planning Commission recommends approval of T 138-2001. Planning Commission further recommends to Council that they consider an ordinance to address the issue of the entrance ways as far as signage, fencing, plantings, electrical and sprinkler systems and other components and establishment of a fee. APPROVED 7-0, REFERRED TO BUILDING & LANDS COMMITTEE

T 159-2001 A resolution accepting the City Engineer’s findings and directing ODOT (Ohio Department of Transportation) to rescind the Director’s Journal Entry thereby reinstating a thirty-five (35) miles per hour speed limit to the herein described portion of Center Ridge Road. REFERRED TO SAFETY COMMITTEE

T 161-2001 An ordinance establishing the salary for the Safety-Service Director of the City of North Ridgeville. GILLOCK/OVERBY SUSPENDED BYLAWS, FIRST THROUGH THIRD READINGS, MINNICK MOVED TO ADOPT AND WAS REJECTED 5-2 (Butkowski, Minnick favored approval)

T 163-2001 An ordinance creating the Department of Economic Development and establishing the qualifications for the full-time position of Director of the Department of Economic Development. THE MAYOR SUGGESTED THE SALARY COULD BE $50,000/YEAR

T 164-2001 An ordinance authorizing the Mayor to advertise for bids and enter into a contract according to law and in a manner prescribed by law for the south Barton Road reconstruction from Center Ridge Road southeast to the corporation line, to consummate a zero percent interest loan agreement with the Ohio Public Works Commission, and to negotiate and enter into a contract with a consulting engineering firm for plans, specifications, and construction phase services for same, not to exceed $180,000.00.

T 165-2001 An ordinance authorizing payment to Lorain County Transit Service.

T 166-2001 An ordinance amending Chapter 1022 street or alley name changing, vacating or narrowing procedure, to add language allowing the street to revert in equal portions to abutting property owners.
