NANCY and ANDREW RIGNEY
From Deed
JONHN EDWARDS and Wife
This indenture made this 17th day of July 1858 between JOHN EDWARDS and ROWAN his wife, of the first part and NANCY and ANDREW RIGNEY of the other part. Witnesseth that for and in consideration of the sum of one hundred dollars in hand paid by the said NANCY and ANDREW RIGNEY to the said JOHN EDWARDS, the receipts whereof is heby acknowledged, has bargained and sold and by these presents doth give, grant, bargain and sell unto the said NANCY and ANDREW RIGNEY their heirs and assigns a certain tract or parcel of land containing sixty acres more or less lying in the County of Carroll on the east side of the Blue Ridge on the Waters of PAULS CREEK and bounded as follows.......etc., etc.,................. with its appertenances to have and to hold the aforesaid tract or parcel land to the said NANCY and ANDREW RIGNEY, their heirs forever and the said JOHN EDWARDS and ROWAN, his wife dot covenant with the said NANCY and ANDREW RIGNEY and thier heirs a good and lawful title to the aforesaid land against the claims of all person whomever. Witness the following signature and seals. Singed JOHN EDWARDS (seal) and ROWAN EDWARDS (Seal) both marked with an X.
There is also a statement that ROWAN was interviewed separately regarding this deed and did agree of her own free will to sign this document. Attested to by SAMUEL D. STAPLES, JP and LEVI EDWARDS, JP.
1.) I believe that because NANCY RIGNEY is not referred to as NANCY wife of ANDREW, that she is not his wife. I have long held that she is his Mother and that she lived with ANDREW at least through the 1850 (Carroll Co., VA) census, where she appears as a 55 year old women living with ANDREW.
2.) What is the significance of this deed being of the same date, and apparantly of the same tract of property as the next deed, found on same page of the deedbook noted above.

NOAH and DAVID RIGNEY

JOHN EDWARDS and WIFE
1858 Aug cert'd.
This indenture made this 17th day of July 1858 between JOHN EDWARDS and ROWAN, his wife, of the first part and NOAH RIGNEY and DAVID RIGNEY of the other part. Witnesseth that for and in consideration of the sum of twenty dollars in hand paid by the said NOAH RIGNEY and DAVID RIGNEY to the said JOHN EDWARDS, the receipt whereof is hereby acknowledged, has bargained and sold and by these presents doth give, grant, bargain and sell unto the said NOAH RIGNEY and DAVID RIGNEY their heirs and assigns a certain tract or parcel of land containing sixty acres more or less lying in the County of Carroll, on the east side of the Blue Ridge on the waters of PAULS CREEK and bounded as follows. Beginning at KINGS CORNER and running the ridge.....etc., etc., etc., ............. with it's appurtenances to have, to hold the aforesaid tract or parcel of land to the NOAH RIGNEY and DAVID RIGNEY their heirs forever and the said JOHN EDWARDS and ROWAN, his wife, doth convenant with the said NOAH RIGNEY and DAVID RIGNEY, their heirs and a good, lawful title to the aforesaid land against the claims of all the persons whomsoever - witness the following signature. Signed by JOHN EDWARDS (sealed) signed by his mark and ROWAN EDWARDS (sealed) signed with her mark.
There is also a statement with this deed that ROWAN was interviewed separately from her husband and it was confirmed that she entered into this document of her own free will. Statement witnessed by SAMUEL D. STAPLES, JP and LEVI EDWARDS, JP
Also attached is a statement from WM. LINDSAY, Teste, District Court that document was presented to the August term of 1858 for recording.
1.) DAVID and NOAH RIGNEY are very small children at this point (1858). Could land be deeded to children in that way then? NOAH was born 1849/50 and DAVID sometime between 1851-53. There is no record of any other NOAH or DAVID in Carroll Co. at that time (that I have found). NANCY HOWELL RIGNEY, grandmother of these two boys, had a son DAVID who died sometime before 1854, four years before this deed.
2.) What is the significance of the deeds being drawn on the same date, and purchased from the same couple, JOHN EDWARDS and ROWAN his wife? Is there an attempt here to circumvent the law in some way?
3.) What is the significance of the next deed drawn on the same day with the same RIGNEY family, but a different EDWARDS family. I believe these EDWARDS' to be the parents of ELIZA EDWARDS, wife of HENLEY C. RIGNEY, child of NANCY HOWELL RIGNEY and father unknown. HENLEY and ELIZA are the parents of the two children noted in the deed above as recipients of 60 acres of land.

NANCY RIGNEY AND OTHERS
1858 August Certf'd.
This indenture made this 17th of July 1858 between NANCY RIGNEY, ANDREW RIGNEY, HENLEY C. RIGNEY and ELIZA, wife of the said HENLEY C. RIGNEY of the first part and JAMES EDWARDS of the other part. Witnesseth that for and in consideration of the sum of $300.00 in hand paid by the said JAMES EDWARDS to the said NANCY, ANDREW and HENLEY C. RIGNEY, the receipt whereof is hereby acknowledged, has bargained and sold and by these presents doth give, grant, bargain and sell unto the said JAMES EDWARDS, his heirs and assigns, a certain tract or parcel of land lying in Carroll County, on the waters of BRUSHY CREEK or fork (the word after BRUSHY is written over) containing one hundred and fifty three acres and bounded as follows to wit. Beginning at a white oak in JONES line with the same....etc., etc., etc.,.... with its appurtenances to have and to hold the aforesaid tract or parcel of land to the said JAMES EDWARDS, his heirs forever and the said NANCY, ANDREW, and HENLEY C. RIGNEY and ELIZA, wife of HENLEY C. RIGNEY, doth covenant with the said JAMES EDWARDS and his heirs a good and lawful title to the aforesaid land against the claims of all persons whomsoever. Witness the following signatures.
NANCY RIGNEY, ANDREW RIGNEY, HENLEY C. RIGNEY, ELIZA RIGNEY-all signed with a mark all sealed.
This deed is accompanied by a statement that the four RIGNEY folks acknowledge this deed to be their act and deed and that ELIZA, wife of HENLEY was examined separately and agrees to the transaction. Statement signed by SAMUEL D. STAPLES, JP and LEVI EDWARDS, JP.
Also attached is record that deed was recorded in Aug of 1858 term. Teste WILLIAM LINDSEY, District Court.
1.) Is it apparent by now that NANCY, ANDREW and HENLEY are related? Do I need more documentation tying them together?
2.) Why isn't Elijah Rigney on this deed? Because by now he is gone and in either Smyth Co, or Wythe Co? Can a son/relative be included on a deed with a signature?
3.) Is this JAMES EDWARDS the father of ELIZA, wife of HENLEY C. RIGNEY? Her father was a JAMES. If he is the father why is he selling property instead of wiling it at his death?
4.) Once again, it is notable that NANCY is not referred to as the wife of ANDREW. (J.T. and MM)

As a matter of interest, I include another document included in this book and on this page. I am beginning to think that the parcel of land on PAULS CREEK changed hands many times on July 17, 1858 and I'm not sure I can figure out why.

Witnesseth that for and in consideration of the sum of two hundred and fifty dollars in hand paid by said LEVI EDWARDS to the said JOHN EDWARDS, the receipt whereof is hereby acknowledged has bargained and sold and by these presents doth give, grant, bargain and seal unto the said LEVI EDWARDS, his heirs and assigns a certain tract or parcel of land containing one hundred acres more or less lying and being in Carroll County on the waters of PAULS CREEK and bounded as follows to wit. Beginning at a white oak etc...etc...etc... With its appurtenances, to have and to hold the aforesaid tract or parcel of land to the said LEVI EDWARDS and his heirs forever and the said JOHN EDWARDS and ROWAN, his wife doth covenant with the said LEVI EDWARDS and his heirs a good and lawful title to the aforesaid land against the claims of all persons whomsoever. WILLIAM TATE and ANDREW RIGNEY-CARROLL CO., VA BOOK 11, PAGE 257-258 Marked on the side of the deed it says "TAX AND FEE PAID"
This indenture made and entered into the 7th day of Januaray 1873 between ANDREW RIGNEY of the first part and WILLIAM TATE of the second part -- all of the County of Carroll and State of Virginia. Witnesseth that the said ANDREW RIGNEY for and in consideration of the sum of $75.00 to him hand paid by the said WILLIAM TATE, before sealing and delivering of these presents hath bargained and sold to the said WILLIAM TATE -- a certain tract or parcel of land lying and being in the County of Carroll and State of Virginia on the waters of LOVELLS CREEK and bounded as follows with: Beginning on a Chestnut oak a corner to BREWER KINGS land etc., etc., etc., .................. on a conditional line between ANDREW RIGNEY and NOAH RIGNEY'S, thence with said conditional to the beginning with its appurtenances containing twenty five (25) acres, more or less, to have and to hold to the said WILLIAM TATE and his heirs and assings forver and the said ANDREW RIGNEY doth by these presents warrant and forever defend the -wrights- (sic) and title of the said land to the said WILLIAM TATE, his airs (sic) and assigns against the lawful claim of all persons whatsoever.
In testimony whereof the said ANDREW RIGNEY hereunto set his hand and affixed his seal this the day and date above mentioned. Signed ANDREW RIGNEY-his mark
Document was accompanied by the usual doc. Swearing that ANDREW and WILLIAM are persons known to the Justice of Peace and also by a statement that this deed was presented, acknowledged and admitted to court records on Nov.(?) 27, 1873
QUESTIONS: Does the tax and fee paid statements on the side of the deed have special signigicance? What does the statement -wrights- means? What is the signigicance of the dash before and after wright? |
