This indenture made the fifteenth day October in the year of our Lord one thousand eight hundred and four, Between-John Hutchinson of the County of Pittsylvania of the one part and Jesse Rigney of the same County of the other part witnessith thee said John Hutchinson for an Inconsideration of the sum of one hundred and twenty nine Dollars to him in hand paid to the said John Hutchinson the receipts of which he doth hereby acknowledge hath granted Bargained and sold unto the said John Huthinson his heirs and assigns forever one certain track or part of land lying and being in the County of Pennsylvania on the fork of the Cherry Stone containing fifty acres of the same more or less and bounded as follows: Beginning at a post oak in Rigney line thence along a new line N55 East 60 poles to a maple on the W bank of the S fork thence down the said creek as it meanders 118 poles to a sycamore. Near the South creek thence division line S30 N46 Poles to the mouth of the ranch up the south branch as it meanders S30 poles to a poplar in Rigney's old line aforesaid and along the same N15 W150 poles crossing a branch to the Beginning together with all houses woods or orchards water and water courses and all the appurtenance their unto belonging as in any other appertaining therewith to have and to hold this aforementioned fifty acres of land with the appurtenances their unto belonging unto the said John Hutchinson. To him and his heirs forever the only proper uses. And behoove of him the said John Hutchinson his heirs and assigns forever and the said Jesse Rigney for himself his heirs the above mentioned land and promises in every part are parcel thereof warrants and will forever the fifty acres of land to be free and clear from all encumbrances what so ever unto the said John Hutchinson and his heirs forever. In witness whereof I here unto set my hand and seal this fifteenth day of October 1804. ~

Notes for Mary Bell Rigney:
The 1900 Federal Census, Delta County of this family includes a black woman, age 70, named Phyllis Bell born in Louisiana. She was a freed slave who had belonged to Mary's parents, and took the Bell family name. She stayed on to help Mary with her young family. Called "Aunt Phyllis" by the family, she lived with the Miller family ubtil her death.
Mary had tuberculosis and it was thought by her doctor that the climate in New Mexico might benefit her health. Her husband cut lumber in his mill to build a house, loaded it, their furniture and farm animals and the family moved to New Mexico. Mary died there in 1903 and her husband and the family moved back to Ben Franklin, Texas.

Emory was a graduate of Texas A & M. He served in the military during WW1. After that he played professional baseball for Detroit, Kansas City and other teams. He was a shortstop and teammate of Ty Cobb. When he retired from ball he open an Independent insurance agency in Harligen Texas. He also invested in farm land in that area. He sold the agency, the land and moved to San Antonio, Texas where he lived until he died.
