ACTION TAKEN BY BOARD
June 8, 1994. Case #94-92. The Board voted that an effort be made by Mr. Trice to obtain the records from the hospital investigating this adverse action report. Further review will be made upon their arrival.
September 9, 1994. Discussion #94-25. Young, Michael W., M.D. After discussion, it was determined that the investigative report made by Buford Newman which had been requested by the Board be sent for an outside review and brought back before the Board at the December meeting.
December 1, 1994. Case 94-25. This case had been addressed at the September meeting and the Board requested that it be reviewed by outside reviewers. After a discussion of the two reports, the Board upon a motion by Dr. Douglas and seconded by Dr. Zini, voted by unanimous vote, to issue a Show Cause Order to this physician.
June 9, 1995. YOUNG, Michael W., M.D., appeared before the Board as requested due to a Notice and Order of Hearing. Dr. Young was represented by his attorney Bill Puttman of Fayetteville. After hearing the evidence in this case, the attorney for Michael W. Young, M.D. made the following offer to the Arkansas State Medical Board to resolve the issues before the Board pursuant to the Administrative Procedure Act, Ark. Code Ann 25-15-208(b). Said offer being as follows:
1. Michael W. Young, M.D. would have his license placed on probation for a period of one (1) year with the following requirements.
a. He would successfully complete one hundred (100) hours of Continuing Medical Education within six months from the date of the order in the areas of family medicine and obstetrics.
b. He will successfully seek permission of the Board prior to obtaining obstetrical privileges performing obstetrical procedures.
c. He would refrain from seeking obstetrical privileges in any hospital until successful completion of his Continuing Medical Education referred to above.
d. He will have a physician proctor and monitor 10% of his charts, giving reports to the Board every three (3) months on the quality of his practice.
e. He will undergo psychological testing and provide said results to the Board.
WHEREAS IT IS CONSIDERED ORDERED AND ADJUDGED THAT the board, pursuant to Ark. Code Ann 25-15-208(b) of the Administrative Procedure Act, accepts the offer of Michael W. Young, M.D., and therefore, Paragraph II (1) is adopted as this Board's Order.
Dr. Zini voiced that he felt there had been a violation of the Arkansas Medical Pract, and wished the minutes to reflect as much. The vote to accept Dr. Young's offer was 6-yes and 5-opposed, with Mr. Feimster abstaining. Those voting to approve the proposal were Dr. R. Williams, Dr. A. Williams, Dr. S. Collier, Dr. O. Compton, Dr. J. Bell, Mr. J. Currie Sr., those opposing the proposal were Dr. R. Jouett, Dr. J. Zini, Dr. L. McGhee, Dr. W. Douglas, Dr. D. Jacks. The motion carried.
November 30, 1995. Discussion 95-39. The Board voted unanimously, upon a motion by Dr. R. Williams, seconded by Dr. A. Williams to accept this as information only and requested further updates to be presented from the monitoring physician at the March, 1996 meeting.
March 7, 1996. Case 96-21. Upon a motion by Dr. J.R. Baker, seconded by Dr. W. Douglas, the Board voted unanimously that there was no evidence of violation of the Arkansas Medical Practices Act.
March 8, 1996. Discussion 96-19. Upon a motion by Dr. D. Jacks, seconded by Dr. O. Clopton, the Board voted unanimously to receive this for information only with the monitoring of the physician to continue.
June 6, 1996. Case 96-21. Upon a motion by Dr. J. Zini, seconded by Dr. S. Collier, the Board voted unanimously that there was no evidence of a violation of the Arkansas Medical Practices Act.
June 7, 1996. Discussion 95-39. The Board upon a motion by Dr. O. Clopton, seconded by Dr. A. Williams, voted unanimously to accept this discussion for information only, and voted that this physician had completed his probationary period and would need no further monitoring.
June 5, 1997. Upon a motion by Dr. A. Williams, seconded by Dr. J. Zini, the Board voted unanimously this physician be issued an Emergency Order of Suspension and Notice and Order of Hearing.
June 6, 1997. Emergency Order of Suspension. License Suspended.
September 12, 1997. YOUNG, Michael W., M.D. appeared due to an Emergency Order of Suspension and Notice of Hearing. Dr. Young was represented by his attorney, William Putman. Dr. Young requested that his hearing be postponed until the December 1997 meeting. Dr. Young indicated his willingness to obtain psychiatric and psychological evaluations from professionals of the Board's choice, as well as undergo any treatment that might be recommended by either. The Board voted, upon a motion by Dr. R. Williams, seconded by Mr. T. Feimster, to grant Dr. Young's request.
December 4, 1997. Case 97-183. The Board voted to table this case until the lawsuit has been settled. The case will be presented to the Board again at that time.
December 5, 1997. YOUNG, Michael W., M.D. appeared due to an Emergency Order of Suspension and Notice of Hearing issued to him. Dr. Young was represented by his attorney, William Putnam. Dr. Young requested that his hearing be postponed until the March 12-13, 1998 meeting and asked for a temporary permit to practice medicine until the March hearing date. Dr. Young stated that he would follow the recommendations of Dr. Richard Owings. The Board voted, upon a motion by Dr. J. Zini, seconded by Dr. T. Pierce, to lift the Emergency Order of Suspension and to return Dr. Young's license temporarily until the March meeting date.
March 13, 1998. YOUNG, Michael W., M.D. appeared due to an Order and Notice of Hearing issued to him. Dr. Young was represented by his attorney, Bill Putnam. After considerable discussion the Board unanimously voted, upon a motion by Dr. A. Williams, seconded by Dr. J. Bell, to lift the Emergency Order of Suspension pursuant to the following requirements:
a. Dr. Michael W. Young will continue to submit to ongoing psychiatric care and evaluations, with said reports being submitted to the Board, with a requirement of psychiatric contact being at least one time every three months,
b. Dr. Michael W. Young will attend, as needed, an ongoing counseling with his therapist, with those reports being forwarded by the therapist to Dr. Owings, his treating psychiatrist, who will forward said reports to the Board.
c. Dr. Michael W. Young can practice only in an institutional environment, such as an emergency room or group practice, or institutional support for practice problems, such as a medical record completion, billing and scheduling, can be accomplished by others, and only in an environment where other physicians can act as a preceptor to evaluate and give advice to Dr. Young during his practice.
d. Dr. Young prior to entering into a practice setting, will inform the Board of the location and environment of his practice, and the name of the individual licensed physician who will serve as his monitor or preceptor.
e. The monitor physician will provide letters to the Board as to Dr. Young's compliance and practice habits on at least a quarterly basis.
June 5, 1998. YOUNG, Michael W., M.D. appeared with his attorney, Bill Putnam. Upon a motion by Dr. J.R. Baker, seconded by Dr. J. Bell, the Board voted unanimously to pass this matter for a period of two (2) years and, upon successful compliance with the terms of this Order, the pending disciplinary charges will be dismissed. The Board further noted that Dr. Young should return for his next update in three (3) months.
September 17, 1998. YOUNG, Michael W., M.D. appeared for his update. Upon a motion by Dr. A. Williams, seconded by Dr. D. Jacks, the Board voted unanimously to continue the monitoring of this physician. The Board further voted Dr. Young should return for his next update at the December 3-4, 1998 meeting.

To whom it may Concern:
SUBJECT: Dr. Michael Young, License #C-7771
I am in receipt of a copy of the Arkansas State Medical Board minutes of disciplinary hearings regarding the above individual. I am OUTRAGED that this individual is still licensed to practice medicine. You have had many opportunities to withdraw his medical license and failed to do so by a narrow margin each time. What's wrong with you?
This man is currently employed as a physician at the Arkansas Department of Correction in the Cummins Unit. I am told by multiple sources not only that he is brutal, uncaring and unprofessional in his actions but that he has "a fascination with anuses and checks the anuses of all the men in the infirmary every day". He also works without the ordered "supervision" of a REAL doctor most of the time, because you should be aware of the fact that within the ADC they do what's most expedient, not what's right, moral or even legal.
You KNOW that this inept and unprofessional pervert has no business having the health and lives of human beings at his mercy and yet you have permitted him to continue to maintain his medical license. As a result he is now in a position to practice his abuse on the most helpless of the helpless; the inmates who have NO CHOICE but to be subjected to his "tender mercies". This is completely unconscionable, and you know it!
I am waging full-blown international WAR against the conditions within the ADC and the lack of medical care provided by CMS. My venue for waging this war is the internet. I have at this time five web sites dealing with abuses of that system and the next one on line will deal specifically with the lack of even basic medical care provided by CMS and the ADC's permitting it continue. It's a well-known fact that CMS and the ADC have no concern for the health and well-being of inmates other than to assist in hastening their deaths through the denial of medical care in order to "hold the bottom line", but you are supposed to be better than that.
Here's what I'm going to do. I am going to give you one month to see to it that the medical license of Michael Young is rescinded. If at that time he is still licensed to practice medicine I am going to put the minutes of your medical board meetings regarding him on the internet and send them to the media. If you have no more concern for the well-being of the people who are subjected to this individual's brand of "medical care" than your permitting him to maintain his license indicates, then the people of Arkansas and the World need to know that. I will make it my business to see to it that they do.
I am not playing; Governor Huckabee and Larry Norris, Director of the ADC can vouch for that. My brother was murdered by the ADC and CMS and I'm determined that the third world country conditions that still exist in Arkansas will NOT be permitted to continue into the 21st Century in MY COUNTRY!!
I expect to hear from you regarding what your intentions are in this matter. Do the right thing, before it's too late for more helpless victims or you'll find yourselves trying to explain it to the whole world.

Dear Ms. Miller
This Board is in receipt of your letter dated August 24, 1999 regarding Dr. Michael Young and his practice of medicine. The Board will be glad to address your concern. Unfortunately, we are unable to do this without the patient's name. We understand that you are writing on behalf of your deceased brother, however, we are not clear as to what exactly happened to his pertaining to his treatment by Dr. Young. In order to receive this information from the physician, a patient name is necessary.
Your letter clearly indicated you are dissatisfied with Dr. Young. The Arkansas State Medical Board will be glad to review the additional information you provide at the next Board Meeting, October 7-8, 1999. Your information will be needed prior to September 24, 1999 for it to be put on the agenda.
