
On 8/17/99 at about 2:00 p.m. Inmate Troy Tucker, #86899 began to experience chest pains. He went to the Barracks 10-B Control Booth to inform Correctional Officer I Bailey that he was having chest pains and needed to go to the Infirmary. Tucker states that at first CO Bailey tried to ignore him, and when he continued to state his problem she said to him, "I'm not fucked up about your chest pains or you, you bitch-ass nigger. You need to move your ass. Hop!"
When Troy refused to leave the area and continued to protest that he needed medical care CO-I Bailey told him, "I'm writing your funky ass up, bitch."
Tucker then asked CO Bailey to call the Infirmary, Shift Supervisor or her Commanding Officer. In response, CO Bailey told him, "Fuck you and your mammy, bitch!"
Lt. Everett, CO-I Bailey's superior officer was close by, and hearing the commotion, went to the door of Barracks 10-B to ask Bailey what Tucker wanted. Tucker explained to Lt. Everett the problem he was having and Lt. Everett told CO-I Bailey that he would escort Tucker to the Infirmary.
As Lt. Everett and Inmate Tucker walked toward the Infirmary CO-I Bailey continued to curse and use threatening gestures toward Tucker but was temporarily restrained by Lt. Everett's voice telling her to back off. Lt. Everett ordered CO-I Bailey to stay at her post, but she disregarded his command, approached Lt. Everett and Inmate Tucker, pulling out her pepper spray cannister and threatening to do harm to Tucker.
Lt. Everett once again commanded CO-I Bailey to get back. She responded by re-holstering her pepper spray, looking threateningly at Tucker and taking two steps back. She then turned suddenly and rushed at the two men, once again wielding her pepper spray.
Lt. Everett and another officer, CO-I Vernor were between CO-I Bailey and Inmate Tucker as CO-I Bailey rushed at the inmate. Lt. Everett put out his arm in an attempt to prevent CO-I Bailey from spraying Inmate Tucker, but she reached over both the Lt. and the other CO and sprayed Inmate Troy Tucker in the face with pepper spray.
Lt. Everett ordered Inmate Tucker to proceed to the Infirmary to be checked out and ordered CO-I Bailey to report to the Captain's office. She initially refused, but then went into the office.
Inmate Tucker filed an affidavit of fact regarding the incident on 8/17/99 and an Emergency Grievance which was received by Officer D.W. Tate on 8/18/99. At this writing Inmate Tucker is recovered from his chest pains and the effects of the pepper spray. It is unknown at this time what, if anything will be done to discipline CO-I Bailey.
