The discussions contained in this section are written for the layman; the countless moms and dads, husbands and wives, brothers and sisters, sons and daughters of a defendant or prisoner who will in fact, find themselves betrayed by "the system" in which they so unquestioningly trusted. This is for those who will painfully discover that Arkansas has its own brand of "justice", and that the arena of crime and punishment bears little resemblance in the real world to what is popularly depicted on television and in Hollywood movies.
I empathize and sympathize with the thousands of decent people who will learn the bitter truth the hard way. Over the years, I have heard, felt, and shared the anguish of many such people who then wanted "to do something" about an injustice perpetrated against someone they cared about. It soon became an impossibility to attempt to explain what was wrong, why it was wrong, and how to go about trying to do something about it, to mom after mom and dad after dad. Therefore, with the content of this web site, and those to which it is linked, I hope to say in one place and at one time at least a few things that should be said in order to convey the insights about "the system" that must be conveyed, so that any number of people can share the same information and make decisions for courses of action.
Although the writings are expressed in layman's terms, for obvious reasons, every effort is made to incorporate the actual legal principles and threshold authorities that will allow an attorney to also know the substance, or strengths and weaknesses of all that is shared and to have the vital thread from which to begin independent research and shaping of the legal claims suggested. The material may be downloaded for that purpose, or otherwise be freely distributed.
It is also essential that it is understood that the legal bases or theories discussed in this section have generally not yet been tested in courts of law. They are often novel, rarely out-on-a-limb, sometimes bright-line, and occasionally complex. Although I am a certified paralegal and have worked for attorneys around Arkansas for several years, doing research and preparing pleadings for successful litigation in every level of court, in both the state and federal systems, I am not a licensed attorney. What I do, what I know and what I share therefore, will and should always be examined through the filtering glass of a qualified and licensed attorney.
Law, however, is generally a very "rational" discipline, where common sense and material facts present or absent, can compel surprising and even completely unexpected results. Law is also a "living" thing (in Arkansas, a monster), meaning it is constantly evolving and changing, and it is very easy for even qualified or crack attorneys to have overlooked some simple and self-evident detail that can turn an existing principle or precedent on its head.
God's grace to you. May what is written help with at least a little understanding about "where it all went wrong", and about the nature of the beast of a "good ol' boy" system. May it also contribute to what must be done.
