The thread title is not of my authorship. I agree with the sentiment
though. It really is pornographic at times. Those poor women don't even
know. What sort of country is America? I'm going to see if I can get a
CRIPA action from the USDOJ or initiate a civil suit myself. They are
being used for pornography in effect by a state authority. It is
degenerate. I was warned that guys were using this for sex kicks. We
need to get local Churches in Arixzona involved.

This stuff is the talk of the fantasy sex groups. I bet they are all
pre-trial people. Some of those women would be used by pimps, abusive
boyfriends and then end up being used as actresses by Maricopa County in
order that sex perverts on the internet can masturbate to their hearts
content. It was obvious that internet based sex perverts would use it.
It is so utterly dreadful. I'm going to try and get a law suit on the
road. That jail is beyond redemption. It is a sin behind Christ's back.

The insanity of US laws on the Death Penalty
--------------------------------------------------------------------------

I have been thinking about the innocent who are sent to death row, People don't seem to
understand the way it is in USA. Innocence it appears means nothing unless there is some
constitutional error. Which seems hard to prove.
I found this information and I am appalled.

Let us fight this madness.

The fact that the trial of a death row inmate has satisfied procedural requirements does not ,
in itself guarantee he is guilty.
The Supreme Court was obliged to weigh the possible innocence of an inmate against his
procedurally correct trial when it ruled in 1993 on the case of Leonel Herrera. Herrera was
a Latin-American death row inmate in Texas on the point of execution for, allegedy killing a
Latin_American victim.
Herrera did not allege that there had been procedural fault at his trial. He claimed that he was
innocent and that he now had the evidence he needed to prove it. (The difference with the
Richey case is that, this evidence has always been there but was withheld by prosecution and
also not investigated by defence) When the case came before the Supreme Court, no appeal
court had addressed the late innocence claims because they were not linked to a claim about
procedure. (Which is the point I have tried to make. Just because procedure has been followed
it does not make a conviction safe)

The Supreme court found itself unable to arrive at a straighforward conlclusion. It judges,
"that there was no constitutional right to federal relief based on newly discovered evidence
of actual innocence where the original trial had been free from procedural error"
In order to succeed, a late innocence claim had to prove that a violation of the Constitution had
occured at trial. According to the ruling, Federal appeal courts sit "to ensure individuals are not
imprisoned by violation of the constitution, not to correct errors of fact".
Questioned on the ruling, the assistant Attorney General of Texas revealed her commitment to
the execution process. She was asked, "Suppose you have a video tape which conclusivley
shows the person is innocent, and you have a state which, as matter of policy or law simply does
not hear new evidence claims, is there a federal violation?" She answered, "No your Honour, there
is not....such an execution would not be a violation of the constitution"

The States have had decades to fix their capital punishment systems. Yet the best they have
managed
is a system fraught with arbirtrariness and error, where innocent people are sentenced to death, and
it is left not to the courts, not to the States, not to the Federal Government, but to the film makers and
college undergraduates to correct the mistakes. What about the Supreme Court? In 1993, it could not
even make up its mind whether the execution of an innocent would be unconstitutional?

Americans are justifiably concerned about the possibilty that an innocent person may be executed.
Capital Punishment in the US today provides no reliable safeguards against this danger. Errors can
and have been made repeatedly in the trial of death penalty cases because of poor representation,
racial prejudice, prosecutorial misconduct, or simply the presentation of erroneous evidence. Once
convicted, a death row inmate faces serious obstacles in convincing any tribunal that he is innocent.

This is appalling!!! Just because something is legal does not make it right.
and this is why Kenny Richey needs a safe and fair trial so ALL of his evidence can be heard and
so do many other cases. More case than I can imagine I would bet.

In the prisons of the United States, more than 3,500 condemned prisoners are
waiting today to be put to death : men and women, minors and the mentally
handicapped, some of them innocent. Since 1999 the rate of executions
has accelerated; it will soon amount to several hundred a year. It is
the height of injustice that the majority of those to be executed were
born in poverly and belong for the most part to ethnic mi,orities.We Europeans
have also had to live with death penalty. But every European democracy
has now dispensed with it. There are of course domains in Europe where
progress needs to be made, for instance making prisons more humane and
in increasing the effectiveness of our policies of sentencing and incarceration
as factors of social rehabilitation. But the death penalty is the keystone
of inhuman judicial procedure. We want to see it either abolished worldwide
or subjected to a universally decreed moratorium
In november,
2000 the United States will elect a new president. Abolishing the death
penalty should become a major issue in the campaign. It is unthinkable
that the United States either remain a member of the club of nations that
apply it massively (China, Iran, Saudi Arabia, Afghanistan) or be the
last democracy that continues to execute condemned prisoners
Your country is the most powerfull in the world. You often claim that
it is a model for humanity. We appeal to you as friends, with the critical
sympathy that is the mark of true friendship. The death penalty is the
symbol of an archaic mode of justice; what's more, it is totally undissuasive.
By abolishing it or by declaring an immediate moratorium on it, you will
enable many convicetd prisoners to have at last the right to a proper
trial and you will save innocent persons from an unjust death. You will
bring the Declaration of Independance into American prisons. Americans,
do what other civilized democraties have already done : abolish the death
penalty

Today over 3,500 people - men, women, but also minors and mental patients, some of which are innocent - await death in American prisons. The rhythm of executions has steadily increased since 1999: soon several hundred inmates will be executed each year. Worse, many of those in death row come from disadvantaged backgrounds, and most belong to minorities.
Europe once enforced the death penalty, but it has been abolished in all democratic European countries. There are still many projects to humanize prisons and adopt criminal and penitentiary policies that improve the efficiency of rehabilitation. But the death penalty is the keystone and the symbol of inhuman justice! We want to see it disappear from the face of the earth or have a universal moratorium declared.
In November 2000, the United States will elect their new President. Ending the death penalty must become a major campaign feature. The United States can neither side with those who apply it massively (China, Iran, Saudi Arabia, Afghanistan) nor remain the last democracy still to execute prisoners!

You are the leading global power and often try to set a model for humanity. We are approaching you as a friendly, close country, and, as a true friend, must be critical. The death penalty is the symbol of archaic justice, and is furthermore a non dissuasive sentence. By abolishing it, or at least declaring an immediate moratorium, you will allow numerous prisoners to at last have a fair trial and prevent the death of innocent people. You will take the principles of your Declaration of Independence into American prisons.
Americans, do what the other civilized democracies did:
Abolish the death penalty!”
