Subject: IMMINENT: Letter from Missouri Inmate James R. Johnson
I recently wrote Mr. Johnson expressing some of the concerns a few from this
list had about writing to Supreme Court Justice, Clarence Thomas asking for a
Certificate of Appealability. Some of you felt it would anger him, some of
you felt it was just a waste of time all around. This is what Mr. Johnson
had to say about your concerns;
"I don't think the abolitionists understand what is taking place at this
point. The US Circuits have only recently started not hearing some cases.
It came from the law that Clinton signed about 3 years ago to cut down on the
time it takes to push a death penalty case through. There may be some
Missouri cases pending the same delimna that I am in , but at this point
there had not been anyone executed that the US 8th Circuit Court of Appeals (
Federal) hadn't at least looked at before turning the inmate down, in
Missouri that is. Other circuits have. Let's say I don't get a
Certificate of Appealability, I will turn right around and file a Certiorari
with the US Supreme Court. They rarely review a case. If they already have
interest shown by groups on my behalf it may give some weight to take a look
at my case.
It's normally too late if you wait for a decision from the US Supreme Court.
Nor many have survived after that. There is always a slight chance with
heavy public pressure, a court will review a case. "
It is his DESIRE that all who are abolitionists on this list.... will write
to the Supreme Court Justice, Clarence Thomas on his behalf, asking for a
Certificate of Appealability that will require the Missouri Federal Court to
review his case.
FACT* - 3 of the top PTSD Specialists in the United States testified that Mr.
Johnson was in "flashback" to Vietnam the night of the murders
FACT* Dr. Shad Meshad, President and Psychiatrist of the National Veteran's
Foundation is one such doctor.
FACT* Dr. John Wilson who wrote the definition of PTSD for the DSMV-5, which
is a diagnostic manual used by psychiatrists and other medical doctors for
use in diagnosing their patients, was another such doctor.
FACT* Dr. Harry Kormos, former Assistant Chief of psychiatry for the
Veteran's Hospitals, Professor of Psychiatry at University of Berkley,
Berkley CA, private practitioner is another such doctor.
Mr. Johnson's PTSD defense is more than legal strategy! It is a MEDICAL FACT
and if Missouri executes him they will be killing a very ill man!
PLEASE get involved and write to Supreme Court Justice Clarence Thomas and
ask him to issue the CERTIFICATE OF APPEALABILITY this man so desperately
needs.
